A temporary renting of the holiday property has been agreed according to the dates specified by you and featuring on your rental confirmation.
The owner will not be able to reduce the rent even if the client leaves the property earlier.
1 DESCRIPTION
The property which is situated at - 2 Rue André Derain, COLLIOURE (66190) FRANCE and is composed of:
Ground floor: 2 twin bedrooms, two ensuite shower/wet rooms with toilets, kitchen/living/dining room, utility room
First floor: roof terrace, two bedrooms – one twin and one double, one ensuite shower room with toilet, one other shower room with toilet
Terrace and parking around the property.
2 RENT
This booking is completed and accepted with a total rent as specified on the website and your rental confirmation payable totally prior to arrival to the property. A security deposit will be payable when booking the property and the balance 6 weeks prior to arrival date. The client will be responsible in case of no payment of the balance in time.
The rent does not cover and these will be charged on:
Specialist equipment not already on site, e.g. hoist
Specialist equipment on site
Downstairs apartment
Two silicon gel pressure relieving mattresses
Two height adjustable beds
One shower/commode chair
3 DEPOSIT
A deposit of 50% of the total booking cost is payable when the booking takes place according to paragraph 1590 of the Code civil.
In case of cancellation prior to 6 weeks before arrival date, the total amount of the security deposit will be refunded. In case of cancellation after 6 weeks, the owner will be refunded 50% of the total rent. In case of cancellation after 3 weeks, the full rent will be kept by the owner.
4 SECURITY DEPOSIT
A security deposit of Euros 500 is payable prior to arrival date. The client will be refunded at the end of the stay minus:
Holiday tax of Euro 0.40 per person, per day
and any other costs due to a damage on the property while his stay.
The balance of the security deposit will be returned to you in Euros, via PayPal .

This booking is agreed and applied to the general terms and conditions attached.
II – GENERAL TERMS AND CONDITIONS
This booking is agreed and applies to the rules related to a temporary rent of a holiday property and both the owner and the client are eligible to respect it.
This booking applies only to the paragraphs 1713 and followed of the Code civil and the client will have no right to keep hold of the place after the agreed period.
1 ARRIVAL/DEPARTURE
The client can arrive after 4pm only. The key holder must be aware of any delays of arrival.
The departure must be prior to 1200hours.
2 INVENTORY OF FIXTURES
An inventory of the property will be made on arrival and before departure of the clients.
All the appliances are working and have been recently tested. Any complains must be done in a delay of 24 hours after arrival. Any cost related to a negligence of the client will be at his charge.
The client will not be able to claim any discount or compensation on the rent in case of a temporary cancellation or cut of the collective services such as water, gas, electricity or telephone.
3 RENTING
The client will occupy the property himself with his family. Each apartment is suitable for maximum 6 persons. The client will not be able to accept any other persons in his presence or not. Children under 18 are accepted under conditions, please ask the owner for more details.
The client will not be able to lend, re-rent fully or a part of the property even temporarily.
He will not be able to give his right for the rent of the all or part of the property to anyone.
The property is in the centre of Collioure and thus other properties nearby. While the client will have the use of the property and all the accessories while his stay, he must treat the neighbourhood with respect and courtesy and take care not to indulge in or permit any activity which could disturb the calm and tranquillity of the surroundings including causing loud noise at any time and any noise after 10pm. Please note that after 10pm, an excess amount of noise can be warned to the local police and the individuals could be prosecuted. NB – the property is next door to the local police lodgings.
No pets are permitted at L’ORIGINE – with the exception of guide dogs and disability assistance dogs.
4 MAINTENANCE - DAMAGES
The owner will care of the property before the arrival of the client. The property will be in order and ready to receive the client.
The client will resituate the property as he found it on his arrival. All the appliances, accessories and furniture will be putting back at their original place.
The client will be responsible for the damages and lost which happened during his stay unless he can prove that it was due to a fault from the owner or a tiers person. In case of any damage, the owner will be able to claim the costs for the reparation, replacement or the cleaning of the place.
5 INSURANCE
The owner will insure the property against any risks related to a rent for the client. The client will have to alert without delay the owner of any incident or accident happened on the property.
6 SECURITY DEPOSIT
The security deposit as mentioned above will be payable prior to arrival.
This deposit will be refunded to the client at the end of the stay, after the inspection of the property minus the holiday tax and any other costs due to the owner.
The security deposit will be refunded within a month after return of the stay.
7 RIGHT TO VISIT
The client will not be able to refuse a visit of the property when the owner will require one. The owner, or a person authorised by him, will be able to visit the property and oversee the maintenance of the house and the garden.
8 RESOLUTIVE CLAUSE
In case of non application of one of these clauses of this contract, and after 24 hours of abortive discussion, the owner can decide to stop the contract without legal procedure.
If the client refuse to leave the property, a legal document from the French Court will be sufficient to do so.
9 HEALTH AND SAFETY
Asbestos
An expertise for asbestos as been made on the [_________] and has been shown to the client who acknowledges it.
Energy
An expertise for energy performance as been made on the [_________] by the company CDRM and has been shown to the client who acknowledges it.
Technological and natural risks
An expertise for technological and natural risks as been made on the [_________] by the company CDRM and has been shown to the client who acknowledges it.
Electric installations (As from 01/11/2007)
An expertise for the electric and gas installations as been made on the [_________] by the company CDRM and has been shown to the client who acknowledges it.
Lead explosions risks (As from 12/08/2008)
An expertise for lead explosions risks as been made on the [_________] by the company CDRM and has been shown to the client who acknowledges it.
10 LAW APPLIED
This contract applies to the French law. Only the French contract will be valid, the English translation is only an informative guideline.
